These Terms of Service (“Terms”) govern your use of the services, website, and customer dashboard (“Services”) provided by Four Seasons Landscaping Inc. (“Four Seasons”, “we”, “us”, or “our”). By engaging our Services or creating an account, you (“Client”) agree to be bound by these Terms.
01Acceptance of Terms
By accessing our website, creating an account, or signing a Service Agreement with Four Seasons, you confirm that you have read, understood, and agree to these Terms in full. If you are entering into these Terms on behalf of a company, property management firm, or institution, you represent that you have the authority to bind that entity.
If you do not agree with any part of these Terms, please do not use our Services.
02Our Services
Four Seasons provides professional year-round landscape maintenance and property care across Canada, including but not limited to:
- Spring cleanup, lawn revitalization, planting, and irrigation activation
- Summer mowing, trimming, irrigation, and ongoing landscape maintenance
- Fall leaf removal, pruning, and winter preparation
- Winter snow removal, ice control, and 24/7 storm response
- Access to a customer dashboard for service tracking, quotes, and invoices
The exact scope of services delivered to your property is set out in your individual Service Agreement or quote, which forms part of these Terms.
03Account & Registration
To use our dashboard, you must register for an account using a valid email address or a supported single sign-on provider (Google, Apple, or Microsoft). You agree to:
- Provide accurate, current, and complete information;
- Keep your password and credentials confidential;
- Notify us promptly of any unauthorized access;
- Accept responsibility for all activity that occurs under your account.
You must be at least 18 years of age and legally able to enter into binding contracts to register.
04Quotes, Invoices & Payments
Quotes are valid for thirty (30) days from the date issued, unless otherwise indicated. Acceptance of a quote, in writing or through the dashboard, constitutes a binding Service Agreement.
Invoices are due within fifteen (15) days of issuance unless a different schedule is specified in your Service Agreement. Overdue balances may be subject to a service charge of 1.5% per month (19.56% per annum) on the outstanding amount.
All amounts are in Canadian dollars (CAD) and exclusive of applicable taxes (HST/GST), which will be added where required by law.
05Scheduling & Cancellation
Service schedules are established at the start of each season and communicated through the dashboard. We make every reasonable effort to maintain schedules; however, weather, equipment availability, and operational priorities may require adjustments.
Recurring services may be cancelled with thirty (30) days written notice. Winter snow removal contracts run for the full season (typically November 1 to April 15) and cannot be cancelled mid-season except in the case of property sale, in which case prorated charges may apply.
06Weather & Force Majeure
Landscaping is a weather-dependent service. We reserve the right to reschedule, modify, or temporarily suspend services due to severe weather, including but not limited to heavy rainfall, drought conditions, severe wind, or extreme cold.
For winter services, we operate on a snowfall trigger basis as set out in your Service Agreement. Response times are best efforts and may be extended during major storm events, declared emergencies, or other circumstances beyond our reasonable control.
Four Seasons shall not be liable for failure or delay in performance caused by acts of God, government action, labour disputes, or other force majeure events.
07Liability & Insurance
Four Seasons maintains commercial general liability insurance of CAD $5,000,000 and is in good standing with the Workplace Safety and Insurance Board (WSIB). Certificates of insurance are available on request.
To the maximum extent permitted by law, our total aggregate liability for any claim arising from or related to the Services shall not exceed the total amount paid by the Client for the Services in the twelve (12) months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, loss of business, or loss of data, even if advised of the possibility of such damages.
08Intellectual Property
All content on our website and dashboard, including text, graphics, logos, photographs, and software, is the property of Four Seasons or its licensors and is protected by Canadian and international copyright and trademark laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the dashboard solely for the purpose of managing your account and Services.
09Termination
We may suspend or terminate your account and Services immediately, without prior notice, if you breach these Terms, fail to pay outstanding invoices, or engage in conduct that we, in our reasonable judgment, consider harmful to our staff, equipment, or other clients.
Upon termination, you remain responsible for any outstanding balance, and certain provisions of these Terms (including Sections 7, 8, and 10) shall survive.
10Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Ontario, sitting in the City of Toronto.
11Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. For material changes, we will notify active customers via email or dashboard notification at least thirty (30) days before the changes take effect.
Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
